RTIs Filed for Information on Pending Cases at Hyderabad HC Pertaining to Waterbodies Go Unanswered

2 RTIs DATED 5 NOVEMBER 2020 FILED FOR INFORMATION WITHIN 48 HOURS ON WATER BODIES CASES PENDING IN HYDERABAD HIGH COURT – ONE RTI NOT REPLIED, SECOND RTI REJECTED BY PIO, HIGH COURT  – APPLICANT GOING FOR APPEAL.

On 5 November 2020 2 RTI applications were filed seeking information within 48 hours , from High Court Hyderabad regarding number of and details of cases pending on water bodies encroachment/pollution. HC order in WP(PIL)251 of 2020 dated 21 october 2020 was cited in both the RTI applications. 

Matter of RTI as follows:

First RTI query was as follows:

Please furnish us information within 48 hours as this is concerning life of Hyderabad/Telangana.Please furnish us information column wise detailing the following:

1. number of cases pending in High Court from as on 30 september 2020 pertaining to encroachment in water bodies – FTL and/or buffer zone, and encroachmet in outflow channels,/inflow channes/nalas etc connected to water bodies;  plz give row wise information with pil/wp numbers and waterbody involved;

2. number of cases disposed out of the total number given in 1 above.

3. number of cases where encroachment eviction orders issued

4. and number of cases where such eviction orders executed.

Second RTI query as follows:

Please furnish us information within 48 hours as this is concerning life of Hyderabad/Telangana.Please furnish us information column wise detailing the following:

1- Please give us list of number of orders in relation to protection of water bodies, either from encroachment and/or pollution, with case numbers of related PIL and Writ petition and suo moto case by High court, where orders given by high court under Article 21 , Article 47 and Article 51A of our constitution of India or any other articles of constitution or other statutes such as Gos, Acts, etc. as deemed fit by the High Court.

On 4 December 2020 applicant received reply from high court hyderabad that ‘request of the applicant made in the application rejected.’ PIO-cum Registrar Judicial-I has cited the following while rejecting the application:

Applicant is filing an appeal for the sought information in both RTIs. we expect to get information at appeal level.  the appellate authority of high court is registrar general of high court Hyderabad.

The above information on status of RTIs is being placed in public domain for public discourse. 

Right from understaffed high court, to government’s pursuance for full strength of high court and all lower courts, to government’s execution of court orders, to court taking cognizance of authentic water body encroachment information brought in by petitioners/letters, to speedy trial of water bodies cases are all subject to question and need be addressed for wellbeing of the city/state.
