Sub: Restoration of the culvert connecting inflow channels of Mamasani Kunta and Balkapur channel that are now found to be inside enclosed area barricaded by Pheonix Spaces Pvt Ltd.

2. Brief from Survey Report:

Surveyed area: North and outh side of culverts, pipes pulled to the eastern side of the south culvert connected with 6 manholes let out on the road outside the gate;

Present: TSIIC officials as deputed by Zonal Manager, Puppulguda Zone viz., Thasildhar shri chandrasekhar, survey engineer TSIIC, and Dr Lubna Sarwath

Summary Observations: Culvert not restored; Huge concrete construction right in front of culvert;Culvert measuring around 6.30ms being directed into a 600mm dia pipeline towards east outside the gate;

3. We urge TSIIC, Irrigation and all officials  to refer our representations of 24 July 2019, 27 October 2019, 11 October 2019 and our other emails and appended below and give us your report on:

a) How you reconcile the village maps, satellite imageries, SOI topo maps, HUDA and HMDA masterplans of Mamasani Kunta vis-a-vis the culvert identified and partially dug up that has now been obstructed by Phoenix constructions right on the inflow channel of Mamasani Kunta that further connects to the Balkapur channel.

b) Demolition of construction that came up between 24 Dec 2019 and 7 Jan 2020 and restore the culvert/channel;

4. We trust your compliance of the below Supreme Court Order:
As per the Supreme Court orders from time to time on Article 21 on the right to a life with dignity and of change of land use of water zone, that can never be done. In Hinch Lal Tiwari vs Kamala Devi And Ors on 25 July, 2001 Bench: Syed Shah Quadri, S.N. Phukan in Appeal(civil) 4787 of 2001, supreme court said as follows:

‘The Government, including the Revenue Authorities(i.e. Respondents 11 to 13,) having noticed that a pond is falling in disuse, should have bestowed their attention to develop the same which would, on one hand, have prevented ecological disaster and on the other provided better environment for the benefit of the public at large. Such vigil is the best protection against knavish attempts to seek allotment in non-abadi sites.’

“Further it will also help in maintaining ecological balance and protecting the environment in regard to which this Court has repeatedly expressed its concern. Such measures must begin at the grass- root level if they were to become the nation’s pride.“
