Sub: Restoration of the culvert at service road, connecting the inflow channels of Mamasani Kunta and Balkapur Channel that are now found to be inside enclosed area barricaded by Pheonix Spaces Pvt Ltd.

Further to our WhatsApp representation of 21 October 2019, TSIIC-IALA officials surveyed the culvert, inflow channels inside the Phoenix barricaded area and the service road, on 22 October 2019. Subsequently, we had a meeting with you on 29 October 2019 at your office in the presence of the three officials who had surveyed the area.
This is preceded with our representations from 24 July 2019, onwards, that was followed by meetings with MRO Gandipet on 4 October 2019, our meeting with EE Irrigation RR district on 11 October 2019.
MRO Gandipet had initiated the work by excavations both at service road and at Balkapur channel, as part of restoration of the channels that are connecting the culvert at service road now being stated as below:
“M/s Phoenix Spaces Pvt. Ltd has started cleaning the box culvert crossing service road. The work is in progress. The issue will be resolved soon.”
We expect time-bound and professional handling of matters at TSIIC, MRO Gandipet, EE Irrigation, MAUD, HMDA and other officials involved in governance and grievance of this issue. A number of 4-5 days have elapsed towards resolving of this grievance.
We trust your compliance with the Supreme Court orders cited below:
As per the Supreme Court orders from time to time on Article 21 on the right to a life with dignity and of change of land use of water-zone, this can never be done. In Hinch Lal Tiwari vs Kamala Devi And Ors on 25 July 2001 Bench: Syed Shah Quadri, S.N. Phukan in Appeal(civil) 4787 of 2001, the supreme court said as follows:
“The Government, including the Revenue Authorities(i.e. Respondents 11 to 13) having noticed that a pond is falling in disuse, should have bestowed their attention to develop the same which would, on one hand, have prevented ecological disaster and on the other provided better environment for the benefit of the public at large. Such vigil is the best protection against knavish attempts to seek allotment in non-abadi sites.“
“Further it will also help in maintaining ecological balance and protecting the environment in regard to which this the Court has repeatedly expressed its concern. Such measures must begin at the grass-root level if they are to become the nation’s pride.“

It is to inform that vide the E-mail 1st cited Dr Lubna Sarwath has reported that M/s Phoenix Spaces Pvt. Ltd., stating that Navanaami residency in Puppalguda (v) adjacent to Phoenix site is flooded with water due to negligence of
M/s Phoenix Spaces Pvt .Ltd., and requested to resolve the issue. The TSIIC officials have inspected the site and directed M/s Phoenix Spaces Pvt. Ltd., to restore the free water flowing channel immediately adjacent to their site and see that water flow is not obstructed. Accordingly, M/s Phoenix Spaces Pvt. Ltd has started cleaning the box culvert crossing service road. The work is in progress. The issue will be resolved soon. Photos are enclosed.
