Petition for the Immediate Release of Devangana Kalita and Natasha Narwal

In the vast judicial absurdistan that is India’s justice labyrinth, the cases of two currently incarcerated individuals should catch your attention. Devangana Kalita and Natasha Narwal, JNU students, and co-founders of the Delhi-based organisation Pinjra Tod, were hauled off to jail under India’s ultra-draconian UAPA law in mid-2020 for allegedly participating in anti-CAA violence. Their almost year-long jail stay comes at a time when the country is in the grip of a total meltdown — a raging, out of control, fearful pandemic, an economy in complete free fall,  and a health infrastructure in utter shambles. That the government still wishes to spend its resources on framing a pair of young, committed social activists as enemies of the state, speaks volumes of its own insecurity.  

Devangana and Natasha had their bail applications rejected early in 2021 and then again a few days ago, with the Crime Branch Special Cell agencies continuing their “investigations” into the role of the two young activists in a “conspiracy of a large scale”. As the defence counsel noted, they offered no substantive proof  — as is the norm with these kinds of cases. Indeed, the police took efforts to keep their seizure of videos related to the case secret — not sharing them with the defence counsel or even the court (Devangana order, pg4, 4h 4i)! 

Also, go ahead and familiarise yourself with the unimpressive but dangerous illogic used by our  prosecutors and judges in the rejection of Natasha Narwal and Devangana Kalita’s bail pleas. Such secretive and disingenuous actions apart, numerous other discordant elements, such as contradictory statements given by protected witnesses (informants), or out-of-context WhatsApp chats (themselves obtained illegally by the police), make the bail rejection order fundamentally undemocratic. ( In Natasha’s case, she was granted bail for an FIR filed in one police station, only for the police to immediately lodge a second FIR (Page 4, 3f) thereby retaining her in jail.)

It is worth spending a few moments on the UAPA and its bail procedure. As the defence counsel noted in both the cases (Pg 2 & 3, Devangana), the venerable presumption that accused are to be considered innocent till proven guilty implies that the burden of proof for detention leading to an arrest should be high. There should be obvious, evident and demonstrable grounds for such arrests (aka a prima-facie case) made public or at least shown to the judge in a court of law. And even if there are — as the court was pointedly reminded by the defence counsel through the citation of several prior cases of jurisprudence — the bar for the bail rights of the accused for such cases should be far lower than other charges. Further, both Devangana and Natasha — who had been co-operating with the detectives — were students belonging to families with roots in the region and with little motivation to abscond. Everything about the situation pointed to a favourable bail order. But no matter — the court declined, failing yet again to apply their mind. 

Pinjra Tod is aptly described as a contemporary feminist movement which pushes for attitudinal changes around the rights of modern urban women. One such issue is of not infantilizing adult women  –  best exemplified by the curfew rules often found in women’s hostels, which it is claimed are for their own safety. Here’s Devangana — a returnee to India after her Masters in the UK —  articulating the inherent patriarchal regressiveness in such rules. Her friend Natasha spent months in the field in remote areas of Odisha with Adivasi communities, doing research towards her MPhil project. In their collective vision, Pinjra Tod opposes all forms of injustice and hierarchy. They have organized protests against the security crackdown in Kashmir, labour reforms, the privatisation of education and the incarceration of political activists

The passage of the CAA bill clashed with the progressive values of the women, which are in clear opposition to the narrow and divisive vision of our majoritarian government. Devangana and Natasha joined the protests because they understood – in the words of the late Ramsey Clark – that the measure of one’s quality as a public person, as a citizen, is the gap between what one does and what one says.

Natasha’s father understands what is happening very well, explaining clearly how our law enforcement works. For the home ministry, in perpetual election mode, the UAPA, sedition and the Public Safety Act are the legal equivalent of : “If all you have is a hammer, everything looks like a nail.”  Scores of activist members of civic society have simply been disappeared into its “process is the punishment” pipeline.  This pipeline has now been honed to brutal precision by India’s law enforcement and its lapdog judiciary, to extract years or even decades of pitiless revenge from powerless citizens for wholly imaginary crimes. Some have sadly died waiting in jail for their day in court.   

The Bhima Koregaon 16, Akhil Gogoi, Umar Khalid, Safoora Zargar, Sharjeel Imam, Khalid Saifi, Faizan Khan, Hidme Markam, hundreds from Kashmir and thousands from Bastar will all eventually be acquitted but by then the current xenophobic, oligarchic, kakistocratic regime would have achieved what it wants – a crushed subservient population unable and unwilling to offer any dissent. Exactly the opposite of what all these activists are standing for. 

Would it be acceptable to us if Natasha and Devangana end up spending years in pre-trial detention? Do we even want to imagine such a scenario? We need to tell the Home Ministry that enough is enough, that they need to be released NOW.  Sign and share the petition, so that the cage that the Pinjra Tod duo find themselves in, can be broken.

    While I have endorsed this petition, we also need to explore other alternative also since this government has absolutely no concerns regarding human values like morality, liberty with responsibility etc. At the same, Civil society also need rethinking on issues such as labor laws, privatisation, need for common civil code etc.
